State Secretary of Negeri Sembilan

The Office of the State Secretary of Negeri Sembilan refers to the statement made by the Menteri Besar of Negeri Sembilan on 17 September 2026, during an interview session with members of the media, concerning a directive to gazette the Proclamation dated 19 April 2026.
In connection with this, the administration has referred the matter to the State Legal Adviser of Negeri Sembilan to ensure that any action required is carried out in accordance with current law and the Laws of the Constitution of Negeri Sembilan 1959 (UUTKNS 1959).
Further, the Attorney General’s Chambers, in a media statement dated 17 September 2026, stated, among other things, that the Proclamation dated 19 April 2026 is invalid because it does not comply with the mandatory requirements of Article 10 of the UUTKNS 1959.
On the legal position, this administration also accepts the view of the Attorney General’s Chambers that members of the State Executive Council (MMKN) of Negeri Sembilan have no jurisdiction, authority or power under the UUTKNS 1959 to make any announcement concerning the Proclamation. In addition, there is no legal basis for MMKN members to rely on the Proclamation dated 19 April 2026 for their announcement.
On the basis of the above, and of the Attorney General’s Chambers’ media statement of 17 September 2026 as a whole, this administration accepts that advice and will take no gazetting action or any other implementing action in respect of the Proclamation, because such action would be unlawful and unconstitutional.
